Terms of service

These Terms apply to the free hosted service at forms.shibumistack.dev. The service is provided by an independent project maintainer using the public name bitbonsai. The MIT license applies separately when you run the open-source software yourself.

By creating an account or using the hosted service, you accept these Terms.

Using the service#

You may use Shibumi Forms to collect lawful form submissions from sites you control. You are responsible for the fields you ask for, your reason for collecting them, and any notice, consent, or legal basis required for your visitors.

Keep your email account secure. Anyone who can use a sign-in link sent to that address may access your Shibumi Forms account. Check your forms and exports regularly so you can detect missing or failed submissions.

Prohibited data and use#

Keep passwords, authentication secrets, payment card details, health data, government identifiers, and other highly sensitive information out of the hosted service.

Using the service for phishing, spam, malware, harassment, illegal activity, evading service limits, or disrupting other users is prohibited.

Your content and responsibilities#

You keep your rights to form content and submissions. You give Shibumi Forms permission to receive, store, process, display, back up, and export that data as needed to operate, maintain, secure, or recover the service.

You must have the right to submit data to the service. You are responsible for your forms, submission data, privacy notices, legal compliance, and requests from form submitters to access, correct, export, or delete their information.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the operator from claims, liabilities, losses, damages, costs, and reasonable legal fees arising from your content, your collection or use of submission data, your breach of these Terms, your violation of law, or your infringement of another person's rights.

Use at your own risk#

You use the hosted service at your own risk. It is a free, experimental service and is not a records-management, archival, emergency, payment, medical, or other critical system.

The operator does not promise that a submission will be received, stored, delivered, displayed, retained, recoverable, secure, accurate, or available at any particular time. Software defects, operator mistakes, attacks, provider failures, maintenance, or service shutdown may cause data loss or interruption.

Keep independent copies of data you need. Your sole remedy for dissatisfaction with the hosted service is to stop using it and delete your account.

Limits and availability#

Hosted accounts may create up to 10 forms, with up to 10,000 stored submissions per form. Rate limits and request limits are listed in the Limits documentation.

The hosted service has no uptime, support, response-time, or data-preservation guarantee. The operator may reject submissions, change limits, pause or delete an endpoint or account, modify the service, or stop the service at any time. Advance notice is not guaranteed.

Ending use#

You can delete submissions, forms, or your account from the dashboard. Account deletion requires confirmation through your account email. Deleted records may remain in backup files for up to 30 days.

The operator may suspend or delete an account that breaks these Terms, threatens the service, creates legal risk, or causes unusual load. The operator may act without advance notice.

Warranty disclaimer#

To the fullest extent permitted by law, the hosted service is provided "as is" and "as available," without warranties of any kind. The operator disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, non-infringement, security, availability, accuracy, and preservation of data.

The operator does not warrant services supplied by Hetzner, Cloudflare, Resend, internet providers, or any other third party.

Limitation of liability#

To the fullest extent permitted by law, the operator will not be liable for direct, indirect, incidental, special, exemplary, punitive, or consequential loss arising from the hosted service. This includes lost submissions, lost data, unauthorized access, service interruption, replacement-service costs, lost revenue, lost profits, lost goodwill, or lost opportunities.

To the fullest extent permitted by law, the operator's total aggregate liability for all claims arising from the hosted service will not exceed the amount you paid for the hosted service during the 12 months before the event giving rise to the claim. The hosted service is free, so that amount will normally be zero.

Nothing in these Terms excludes or limits liability that applicable law does not allow the operator to exclude or limit.

General terms#

If any provision of these Terms is invalid or unenforceable, it will apply to the maximum extent permitted by law. The remaining provisions will continue to apply. A failure to enforce a provision is not a waiver of it.

These Terms, the Privacy policy, and pages incorporated by reference are the entire agreement for the hosted service. They replace earlier statements about the hosted service.

Changes and contact#

The operator may update these Terms by publishing a new version and effective date. Changes apply from that date. If applicable law requires fresh consent, the service will request it before continued use.
